Terms of Service — OpenVox: Local Voice AI

1. Acknowledgement

This End User License Agreement (“EULA”) is a legal agreement between you (“End-User”) and The Oracle Guy (“Licensor”) for the use of OpenVox: Local Voice AI (“Application”), a software application distributed via the Apple Mac App Store. This EULA is consistent with and supplements the terms of the Apple Media Services Terms and Conditions, which are incorporated herein by reference. Apple Inc. (“Apple”) is not a party to this EULA and is not responsible for the Application or its content.

By downloading, installing, or using the Application, you confirm that you have read, understood, and agree to be bound by this EULA. If you do not agree, do not download or use the Application.

2. License Grant

The Licensor grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application on any Apple-branded device that you own or control, strictly in accordance with the terms of this EULA and the Apple Media Services Terms and Conditions.

If the Application is licensed under the Family Sharing feature of the App Store, this license extends to all members of your Family Sharing group, subject to the same terms.

3. Restrictions

You agree that you will not:

• ✕Sublicense, sell, rent, lease, transfer, assign, or otherwise dispose of the Application;
• ✕Modify, translate, adapt, or create derivative works based upon the Application;
• ✕Reverse engineer, disassemble, decompile, or attempt to derive the source code of the Application, except to the extent permitted by applicable law;
• ✕Remove or alter any proprietary notices, labels, or marks from the Application;
• ✕Use the Application for any unlawful purpose or in any manner inconsistent with this EULA;
• ✕Use the Application to infringe the intellectual property rights of any third party;
• ✕Use the Application to generate content that is illegal, defamatory, harassing, or violates the rights of others.

4. In-App Purchases and Payments

The Application offers optional in-app purchases, including a one-time Pro upgrade (“OpenVox Pro”). All payments are processed exclusively through Apple's in-app purchase system. The Licensor does not collect or store your payment information.

All purchases are final. Refunds are handled by Apple in accordance with their applicable policies. You may restore a previous purchase on any eligible device using the same Apple ID, as permitted by Apple.

5. Intellectual Property

The Application, including all content, features, code, and design elements, is licensed, not sold, to you. The Licensor retains all rights, title, and interest in and to the Application, including all intellectual property rights therein.

Audio files generated using the Application may be used by you for personal and commercial purposes, subject to the terms of any third-party model licenses which are disclosed within the Application or its documentation.

6. User-Generated Content

You retain ownership of any text, audio samples, or other content you provide as input to the Application. By using the Application, you represent and warrant that you have the necessary rights to any content you input, and that your use of such content complies with all applicable laws.

All processing of your input content occurs locally on your device. The Licensor does not receive, store, or access your input content or generated audio.

7. External Services

The Application may facilitate access to the following limited external services:

• •Hugging Face: For one-time model downloads initiated by you. Standard network request metadata may be transmitted.
• •Apple Speech Recognition: Optionally used for transcript detection during voice cloning, only if you explicitly enable this feature and grant permission.

These external services are subject to their own terms and privacy policies. The Licensor is not responsible for the content, privacy practices, or availability of any third-party services.

8. Privacy

Your use of the Application is also governed by our Privacy Policy, incorporated herein by reference. Core voice generation, voice design, audiobook production, voice conversion, and generation history are processed entirely on your device. The Licensor does not collect analytics, usage telemetry, or personal data from within the Application.

9. Maintenance and Support

The Licensor is solely responsible for providing maintenance and support services for the Application. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Application.

10. Warranty Disclaimer

The Application is provided “AS IS” and “AS AVAILABLE” without warranty of any kind. To the maximum extent permitted by applicable law, the Licensor expressly disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.

11. Product Claims

The Licensor, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and use of the Application, including but not limited to:

• •Product liability claims;
• •Any claim that the Application fails to conform to any applicable legal or regulatory requirement;
• •Claims arising under consumer protection, privacy, or similar legislation.

12. Intellectual Property Infringement

In the event of any third-party claim that the Application or your possession and use of the Application infringes a third party's intellectual property rights, the Licensor, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

13. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Licensor be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Application.

The Licensor's total liability to you for all claims arising out of or relating to this EULA or your use of the Application shall not exceed the amount you paid for the Application in the twelve (12) months preceding the claim.

14. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

15. Governing Law

This EULA is governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under this EULA shall be subject to the exclusive jurisdiction of the courts located in India.

16. Changes to This Agreement

The Licensor reserves the right to modify this EULA at any time. Updated terms will be posted at openvoxai.com/terms-of-service. Continued use of the Application after changes are posted constitutes your acceptance of the revised terms.

17. Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms hereof, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
